Employment contracts

Salary structuring

Monthly payroll cycle with 14 annual payments, including holiday and Christmas bonuses. Payments processed by the last working day of each month in euros with full compliance with collective bargaining agreements.

Taxes

Progressive income tax system with rates from 0% to 55% based on 2025 brackets. We simplify withholding & submission to Austrian tax authorities by the 15th of the following month with proper documentation as required by the authorities.

Tax varies based on the employee’s salary and the number of children the employee has.

Salary

Salaries are paid in EUR on a monthly cycle, aligned with local law. Additional typical 13th (“summer”) and 14th (“Christmas”) salary bonuses are customary via collective agreements.

Social security contributions

This covers health, pension, accident, unemployment, registration, and payments handled electronically via ELDA by the 15th of the following month.

Pension

Employers contribute ~12.55 %, employees ~10.25 %. Required 15-year contribution minimum for eligibility; full benefit (~80 % of lifetime income) attainable after ~ 45-year contributions.

Working hours

Austrians generally work eight hours a day/40 hours a week, with a maximum working week being set at 60 hours, and working time cannot exceed this time. However, many industries have an agreement that sets their workweek to 38 hours in line with a collective bargaining agreement. 

Austria Employment Law

Austrian employment laws are diverse and complicated. The country is very employee-friendly, and it has over 80 collective bargaining agreements in place.  As the legal employer of the employees, we navigate Austria’s comprehensive labor regulations, including written or Dienstzettel contract requirements, collective agreements, working time rules, and termination statutes, along with many other legal obligations, so you don’t have to.

Worker classification & penalties

Misclassifying employees as contractors can trigger retrospective employment rights obligations, social security and tax liabilities, and fines up to EUR 400,000.

Annual leaves

Employees are entitled to five weeks of paid annual leave per year (about 25 working days for a five-day week), increasing to six weeks (30 working days) after 25 years of service. In addition to the statutory vacation, employees are also entitled to 13 additional paid holidays for Public Holidays.

Sick leave

Employees may receive full pay sick leave depending on years of service: from six weeks, rising to a maximum of 12 weeks. Employees can also receive an additional 4 weeks paid at 50%. Paid sick leave is dependent on the length of service and whether the employee has been sick within the last 12 months.

Maternity leave

Employees are entitled to 16 weeks of maternity leave, typically eight weeks before birth and eight weeks after, extendable to 12 weeks after delivery in high-risk or caesarean birth cases.

Family Friendly leave

There are various family-friendly leaves available for parents as requested. Some leaves are paid and others are unpaid. Understanding the specific obligations are essential in order to avoid discrimination claims in the future for non-compliance.

Notice periods 

The minimum notice period is 6 weeks, and the maximum notice period is 5 months. Notice period depends on employee tenure and also the reason for termination. For all terminations in Austria, mandatory processes need to be followed and adhered to in all cases. 

Severance & final payouts

Austria employs two severance systems: 

Abfertigung Neu: Since 1 January 2003, contributions of 1.53% of the monthly salary are made to a severance fund (Mitarbeitervorsorgekasse), from which payouts become available after 3 years of contributions under qualifying circumstances. The employee can access this fund upon termination.

Onboarding usually takes 5-7 business days, assuming documents and approvals are completed on time.
