Employment contracts

Salary structuring

Belgian salaries usually include a fixed gross amount plus allowances and benefits. Our offering allows us to stay compliant whilst understanding the different sector requirements. 

Taxes

Running payroll in Belgium involves calculating net salaries after applying many different criteria in order to determine the payable Tax for each employee. It is a complex system with many different variables. 

Salary Payments

Salaries are paid monthly in euros with detailed payslips showing deductions and contributions. Holiday pay may be issued separately, and payments follow statutory filing timelines.

Public health insurance

Belgium provides a public health insurance scheme for all employees, funded through social security contributions. This is a mandatory payment in all cases. Coverage includes medical care, hospitalization, and prescriptions.

Pension contributions

Pensions can be split into three categories: the state pension, which is paid by the employer; the personal pension, which is set up by the employer in a specific sector, and or the employee’s private pension, which is the responsibility of the employee and is an optional product. 

Holiday pay

Employees working a full calendar year are entitled to four weeks, or 20 days (for a five-day working week) of paid annual leave the following year. Different accrual principles apply to employees starting partway through the year, with holiday pay calculated based on sector rules, along with additional legal requirements.

Worker classification & employment contract

Belgium favors full-time employment over contract work, and misclassification can lead to legal and financial penalties. A written employment contract must include role, salary, hours, benefits, and termination terms.

Audit-ready documentation

Accurate, timely employment and payroll records are required for inspections. Employers must maintain employment contracts, payslips, leave records, and tax filings in line with legal retention periods.

Sick leaves

White-collar employees receive full salary for the first 30 days of illness, after which public health insurance provides benefits. Sick leave to care for family members is also allowed.

Maternity & paternity leaves

Eligible mothers can take six weeks before birth and nine weeks after, with the entitlement being 15 weeks. Fathers receive paid paternity leave of 25 days. Adoption leave of six weeks with an additional six weeks is also available for parents to share between themselves once a child is placed in their care.

Notice periods 

Notice depends on the role and seniority of the employee. The range of notice will range from one week for those with less than three months service, increasing to twenty-six weeks for those with twenty-one years service and above.
