Employment Contracts

All employment contracts are drafted according to the Employment Ordinance (Cap. 57), clearly defining salary, responsibilities, working hours, probation terms, and termination clauses.

Salary structuring

Taxes

Hong Kong imposes a progressive personal income tax system with rates ranging from 2% to 17%. Employers must withhold and remit payroll taxes and file annual IR56B returns, all handled for you.

Mandatory Provident Fund (MPF)

Annual leaves

Employees are entitled to a minimum of 7 days of paid annual leave after one year of employment, increasing progressively to 14 days based on tenure.

Sick leave

Employees accrue 2 paid sickness days per month during the first 12 months and 4 days per month thereafter, up to a maximum of 120 days;; payments are handled by employer or insurance as appropriate.

Maternity leave

New mothers are entitled to 14 weeks of paid maternity leave at 80% of average daily wages, with the employer eligible for government reimbursement for weeks 11 to 14 (capped at HK$80,000). Fathers are entitled to 5 days of paid paternity leave at 80% of average daily wages, subject to a continuous service requirement of at least 40 weeks.

Notice period

During the first month of probation in Hong Kong, no notice or payment in lieu is required unless the employment contract specifies otherwise. After the first month, the statutory minimum notice is 7 days or salary in lieu, unless the contract provides for a longer period. Post-probation, the default statutory minimum is one month’s notice or salary in lieu, subject to the terms of the employment contract, but in no case can the notice be less than 7 days.

Severance pay/ Long Service Payment

In Hong Kong, employees may be entitled to either a Severance Payment (SP) or a Long Service Payment (LSP), but not both. SP applies to those with 24+ months of service dismissed due to redundancy, while LSP applies to those with 5+ years of service dismissed for other reasons or resigning due to incapacity or age 65+. Both are calculated as two-thirds of last month’s wages × years of service, with respective caps.
