Salary structuring

Our EOR in Malaysia helps you structure your employee’s salary as per Malaysia’s statutory requirements, including minimum wage, retirement savings, and leave entitlements.

Taxes

We can help you figure out Malaysia’s progressive tax rates (typically up to 30% based on the income for residents, and a flat 30% for non-residents), monthly deductions, and corporate tax reporting.

Employees are paid in MYR with payslips generated monthly. Our EOR takes into account public holidays and tax deadlines while processing payroll.

Employees Provident Fund (EPF)

Employees contribute 11% of their monthly salary to EPF, while employers contribute 13% (12% if the monthly salary exceeds RM5,000). For employees aged above 60, the contribution depends on their employment status and monthly wage rate.

Pension & retirement savings

Malaysia’s retirement age is 60. EPF savings can be withdrawn by age 75, with unclaimed funds transferred to the Registrar by age 80. We can help you track this so you stay compliant throughout the employment lifecycle.

Malaysian Employment Act coverage

Malaysia’s Employment Act, 1955 governs all full-time, part-time, and fixed-term employees, including non-residents working in Malaysia. We can help you align every employment contractand process with these legal standards.

Mandatory contributions

We can help you manage employer obligations under the Employees Provident Fund Act, 1991, including monthly EPF payments and age-specific contribution rules.

Annual leaves

Employees in Malaysia receive 8 days of leave if employed for under 2 years, 12 days for 2–5 years, and 16 days for over 5 years.

Sick leave

Employees are entitled to 14 days if employed under 2 years, 18 days for 2–5 years, and 22 days for over 5 years (where no hospitalization is necessary), with up to an additional 60 days of paid hospitalisation leave if certified by a medical practitioner.

Maternity leave

Malaysia mandates 98 days of paid maternity leave per confinement. Employees must have worked at least 90 days in the last 9 months and been employed during the 4 months immediately before confinement. Termination is prohibited during leave, and a 90-day buffer applies after.

Notice periods & documentation

Notice periods in Malaysia are tenure-based: 4 weeks for under 2 years, 6 weeks for 2–5 years, and 8 weeks for over 5 years. We help you deliver the right notice, documentation, and communication at every step.

Probationary policies

Probation periods typically range from 1 to 6 months. Malaysian law does not differentiate between probationers and full-time employees; all receive statutory protections. We help you manage clear, compliant terms from day one.
