Employment contracts

All employment contracts comply with Maltese law, are delivered in writing (typically English), and clearly outline job role, compensation, place of work, rest breaks and working hours, probation, leave entitlements, termination clauses,  notice requirements, and where required, collective bargaining terms.

Salary structuring

We ensure that compensation packages are compliant with Maltese regulations, including sector-specific Wage Regulation Orders, and include all statutory deductions, calculated accurately for social security and taxes.

Taxes

Employees and employers each contribute around 10% of basic weekly wages to Social Security (Class 1), subject to maximum and minimum thresholds, plus a 0.3% weekly contribution to the Maternity Fund. Personal income tax is progressive from 0–35%, with brackets based on an employee’s tax status (single, married or parent).

Salary

Employees receive regular monthly payouts in EUR, accompanied by payslips that list all statutory deductions. Payments are aligned with statutory payroll deadlines, generally paid on the last working day of the month.

We manage registration and timely monthly remittances to Social Security and the Maternity Fund for both employers and employees.

Working hours

The Maltese employees in the private sector generally work 40 hours per week, with a maximum of up to 48 hours including overtime. Daily office hours can vary by employer, but are generally from Monday to Friday, 8 am to 5 pm.

Labor Law coverage

We ensure full compliance with Malta’s Employment and Industrial Relations Act, Social Security Act and where applicable, sector-specific Wage Regulation Orders or collective bargaining agreements. 

Worker classification & penalties

Proper classification of employee vs contractor and processing of accurate payroll are essential to avoid penalties. We handle employment type classification and payroll documentation precisely, to mitigate the risk of any enforcement or fines from the Department of Industrial and Employment Relations (DIER).

Annual leaves

Full-time Maltese employees are entitled to 192 hours (24 working days) of paid annual leave per year. Additional days are granted if public holidays fall on a weekend. Malta currently observes 14 statutory public holidays. For part-time employees, the entitlement is pro rated.

Sick leave

Sick leave entitlements in Malta are determined by sector-specific Wage Regulation Orders. In most sectors, employees are entitled to at least 2 working weeks of paid sick leave per year. Typically, the employer pays the first 3 days of each sickness spell, and subsequent days are covered by Social Security sickness benefits, provided a medical certificate is submitted. 

Maternity leave

All pregnant employees are entitled to 18 weeks of maternity leave. The first 14 weeks are paid by the employer at full wages, while the remaining 4 weeks are covered by Social Security maternity benefits. No minimum service period applies.

Notice periods 

Notice periods in Malta depend on the length of service. Employees with less than one month of service require 1 week’s notice. Thereafter, notice ranges from 2 weeks (for 1–6 months’ service) up to 12 weeks (for over 9 years’ service). Either party may terminate with notice or pay in lieu, unless dismissal is for good and sufficient cause or occurs during probation.

Severance & final payouts

Typically, there is no statutory severance payment in Malta. However, employees must be compensated for any unused leave and any other accrued entitlements at termination. We ensure full and timely payouts.

In redundancy situations, the last-in-first-out rules apply within comparable roles, and employees may seek compensation for unfair dismissal if termination is not supported by good and sufficient cause.
