Employment Contracts

We offer temporary employment contracts (for an uncertain period of time up to 4 years) and, exceptionally, we also offer indefinite employment contracts. Employment contracts can be part-time or full-time, and we always ensure that they clearly define the role, salary, benefits, working hours, and termination terms in accordance with the Labor Code.

Social Security

In general, employers contribute 23.75% of an employee’s salary, while employees contribute 11%. It covers pensions, unemployment benefits, sickness pay, parental leave payments, and family allowances.

Public Health Insurance

Employees have access to Portugal’s national health system (Serviço Nacional de Saúde – SNS), which provides healthcare services at subsidized rates.

Labor Accident Insurance

Mandatory employer-paid insurance covering medical costs, disability, or death due to workplace accidents.

Wage Guarantee Fund (WGF)

Employers contribute 1% of salaries to protect employees’ wages if the company becomes insolvent.

Employment laws

Written employment contracts are mandatory for most employment types and must be in Portuguese. They must specify salary, benefits, working hours, job duties, and termination clauses, and list all compensation in Euros.

Worker classification

Employees work under the employer’s direction, with social security contributions split between the employer and employee. Contractors work independently, pay their own contributions, and may be subject to VAT.

Key Labor Code provisions

The Labor Code outlines rules on working hours (maximum 40 per week), overtime pay , mandatory benefits, and workplace safety requirements.

Bonuses

Bonuses aren’t mandated. They’re discretionary and vary by sector or seniority, more common in industries like tech, media, and engineering, or for roles like directors and senior managers.

Variable Compensation

Much like bonuses, variable compensation, such as commissions, is not mandated; however, they are common in many industries.

Annual leaves

Employees receive a statutory minimum of 22 paid working days per year.. Employers may offer additional days as part of the benefits package.

Sick leaves

Employees are entitled to paid sick leave from the 4th day of absence, with the benefit paid by Social Security. Payment rates vary with the length of absence, typically 55% to 75% of the salary.The employer is obliged to pay the employee wages for the first two days of sickness.

Maternity leaves

Social Security funds 120 days of paid maternity leave. The mother must take at least 42 days after birth. Leave can be taken in full or partially before and after childbirth. Extended leave options may be available in cases of multiple births or medical complications.

Notice periods

Notice period varies depending on the type of employment contract and its length. There are also different notice periods during and after probation.

Severance

Mandatory in certain termination cases, calculated based on the employee’s base salary and years of service, in accordance with Portuguese labor law.

Payoneer Workforce Management employs the team directly on its platform to work directly for the customer’s business. This will take away the customer’s need to set up their own entity and incorporate costly infrastructure into their business, such as HR, compliance, etc.. We take care of employment contracts, payroll, and benefits.

We manage statutory benefits such as social security contributions, public health coverage, labor accident insurance, and the wage guarantee fund.

The EOR concept is not legally recognized in Portugal yet, but the concept means that the legal employer of record, in this case Payoneer Workforce Management, is the legal employer of the individual placed to work in the customer business. The EOR is responsible for handling employment contracts, payroll, taxes, and compliance, so the EOR can hire full-time employees in Portugal without the customer setting up a local entity.

Onboarding timelines depend on document readiness and approvals. Once employment contracts are signed and documents are in, onboarding typically takes 3–5 working days.

Most employment contracts must be in writing and in Portuguese. They should include job details, salary, benefits, working hours, and termination clauses, and follow Portuguese labor law and applicable CBAs.
