Employment Contracts

We support full-time, part-time, fixed-term, and contractor agreements compliant with Serbia’s Labor Law, clearly specifying role, pay, working hours, leave entitlements, probation, and termination terms.

Background checks

We run proper checks so you don’t have to hope for the best. Comprehensive screening aligns with Serbian employment standards and regulatory requirements where possible and applicable.

Visa & Work Permits

Serbia offers two work visa types: C visa for stays under 90 days and a D visa for over 90 days. A separate work permit is also needed, obtainable only with a job offer after the employer confirms no local workers are available.

Salary structuring

We structure salary into base pay and allowances, calculating social security contributions precisely in line with the unique requirements as mandated by law.

Taxes

Personal income tax: flat 10%, with additional 10% or 15% rates for high earners. We manage monthly withholding, filings, and compliance. 

There are additional Tax incentives for individuals residing in Serbia.

Salary

Employees are paid in RSD in line with the employment contract as agreed, which is then documented in monthly payslips. Payroll is aligned with the contractual obligations, including tax deductions, holidays and public holidays whilst complying with the statutory deadlines.

Social security

Includes pension, disability, health, and unemployment benefits; contributions withheld and remitted per legal requirements; capped based on average salary limits.

Overtime

Standard workweek: 40 hours. Overtime is capped to daily/weekly limits and paid at a minimum 126%. Work on public holidays pays at 110%.

Annual leaves

Employees are entitled to a minimum of 20 working days of annual leave per year.

Sick leave

Sick leave in Serbia is complex. Employees are entitled to paid sick leave for up to 12 months. This leave is paid at different rates and by different payers depending upon the length and type of sickness, but cannot be any less than 70% of the employee’s regular monthly salary.

Maternity leave

Employees are entitled to maternity leave, which varies in length from 1 to 2 years depending on the number of children.

Notice period

The minimum notice period as dictated by law ranges from eight to 30 days. The notice period will depend on the circumstances of the termination and whether a process needs to be followed. A longer notice period can be agreed in the employment contract.

Severance & final payouts

In Serbia, all employees who are terminated due to redundancy are entitled to severance pay. Severance pay is 1/3 of the employee’s monthly salary per year of service. Upon termination, accrued but untaken vacation, unpaid salary, including notice pay, and any additional mandatory payment must be paid within 30 days from the date of termination.
