Salary structuring

We meet Spain’s national minimum wage (€16.576/year in 2025) and set compensation that aligns with industry standards.

13th & 14th month salary

Common practice in Spain. We structure salary payments either monthly or split across summer and year-end.

Income tax (IRPF)

Payoneer Workforce Management manages monthly income tax (IRPF) withholding based on the employee’s contract, salary, and personal situation. All withholdings are reported and paid to the Agencia Tributaria.

Payslips & payments

We issue payslips in Spanish, and pay the employees monthly in EUR via secure SEPA transfers.

Public pension insurance (social security contributions for common contingencies)

Employees contribute 4.7% of their gross salary; employers contribute 23.6%. Spain offers one of the highest pension replacement rates in the EU.

Social security coverage

We manage all employer and employee contributions to Spain’s national system, covering healthcare, pensions, unemployment, and disability benefits.

Severance pay

We calculate and manage severance in compliance with Spanish labor law, typically 20–33 days’ salary per year worked, depending on dismissal type.

Bonuses

Bonuses aren’t mandated. They’re discretionary and vary by sector or seniority, more common in industries like tech, media, and engineering, or for roles like directors and senior managers.

Variable Compensation

Much like bonuses, variable compensation, such as commission, is not mandated; however, they are common in many industries.

Employment laws

Spanish labor laws are defined by the Workers’ Statute and collective bargaining agreements. We align every employment contract, benefit, and payroll accordingly.

Mandatory protections

Statutory rules apply to working hours (40 per week), overtime (up to 80 hours per year), paid leave, probation periods, and notice periods, all of which must be managed in line with local regulations.

Anti-discrimination & workplace safety

Spain enforces strict non-discrimination rules under Article 14 of the Constitution and Article 17.1 of the Workers’ Statute. Employers are expected to maintain safe, inclusive workplaces with clear protocols in place.

Annual leaves

Employees are entitled to a minimum of 30 calendar days (or 22 working days) of paid vacation per year. Collective agreements may extend this.

Sick leave

Up to 365 days of paid medical leave, extendable to 540 days. For sick leave due to a common illness, employees must have at least 180 days of social security contributions in the last 5 years for eligibility.

Leave for birth and childcare (Maternity leave)

19 weeks of paid leave: (i) first 6 weeks mandatory post-birth, (ii) 11 voluntary weeks that may be taken in a non-consecutive manner, until the child reaches 12 months of age and (iii) 2 additional weeks until the child reaches 8 years. Covered by Social Security.

Employee resignation

Employees typically give 15 days’ notice, depending on their contract or applicable collective agreement.

Probation periods

Standard probation is up to 6 months for qualified technicians and 2 months for other employees. No notice is required during this period.

Employer-initiated termination

Dismissals must follow strict legal procedures. For economic/organizational reasons: 15 days’ notice + severance of 20 days per year worked (up to 12 months). Unfair dismissal: 33 days per year worked, capped at 24 months.

Even though the EOR is not legally recognized in Spain, there has been a recent ruling of the Court of Justice of the European Union (October 24, 2024, Case C-441/23) that could pave the way for EOR companies in Spain as an alternative to traditional temporary employment agencies. This ruling may mark the beginning of a change in Spanish regulations and allow for progress toward the EOR model.
