Employment contracts

Vietnamese law mandates written labor contracts, fixed-term or indefinite, signed before Day 1. These agreements must cover role, compensation, working hours, benefits, termination, and probation, and may be bilingual (Vietnamese/English) for clarity.

Salary structuring

We design compensation packages (base pay plus allowances) to ensure correct deductions for social insurance, health insurance, and unemployment insurance.

Taxes

Vietnam applies progressive personal income tax; we manage withholding, monthly filings, and ensure net pay compliance, including customary bonuses like Tết (Lunar New Year), though not mandatory. 

Payouts

Salaries are paid monthly in VND, with payslips delivered per regulatory timelines and aligned to public holidays and payroll cutoffs.

Social insurance

Vietnam mandates contributions to social, health, and unemployment insurance. Employers typically contribute around 21.5% (SI 17.5% + HI 3% + UI 1%), while employees contribute around 10.5% (SI 8% + HI 1% + UI 1.5%), all subject to statutory salary caps. 

Minimum wage

Contributions are based on the official monthly salary as defined in the labor contract, capped at 20 times the regional minimum wage for social and health insurance basis.

Labor Law coverage

Our services ensure full compliance with Vietnam’s Labor Code, Social Insurance Law (including the new 2024 revisions effective July 2025), and Decree on data and employment standards.

We maintain employment contracts, payslips, social insurance filings, leave records, and termination documents, fully prepared for government audits or inspections.

Worker classification & penalties

Misclassifying employees as contractors carries risks: fines, back contributions, and labor disputes. We ensure all employees are correctly classified and protected.

Annual leaves

Employees with 12 months of service receive 12 days of annual leave (14–16 for hazardous roles), plus one day extra per five years of service with the same employer. Public holidays add ~11 paid days per year.

Sick leave

Employees are entitled to paid sick leave for up to 30 days. The employee will receive 75% of their salary while on leave, paid by Social Security. 

Maternity leave

Pregnant employees who have contributed to social security for at least 3 months are entitled to 6 months of paid leave. 2 weeks of leave can be taken before the child’s birth. The employee will receive 100% of the average salary based on social insurance contributions over the last 6 months.

Notice periods 

The minimum notice period is 3 days for a fixed-term contract of less than 12 months and will be increased to 45 days in case of an indefinite term contract..

Severance & final payouts

Employees dismissed without cause or due to restructuring are entitled to 0.5 months’ salary per year of service as severance.
